SECTION 327

Under this Kanooni Dhara of the IPC ,punishes any person who voluntarily i.e. on his/her own free will causes hurt to anyone for the purpose of extorting property from him or any person interested in the victim or compels the victim or any person interested in him/her to do an illegal act or facilitate the commission of an offence.

Ingredients of the Section: The following are the essentials of this section ;

1. A person should voluntarily cause hurt

2. This act of the person should be for either of the two purposes;

1. For extorting property or any valuable security  from the victim or any person interested in the victim 

2. For compelling the victim or any person interested in the victim to do an illegal act or facilitate the commission of an offence..

Punishment: Any person liable for an offence under this section shall be punished with the punishment of imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine

Example: Sunil beats up Krishan’s son in order to extort money and all the jewels he had on him. Here Sunil will be liable under this section as he voluntarily caused hurt to a person (son) in whom Krishan was interested in the purpose of extorting the valuable security i.e. Krishan’s money and jewels from him.

Composition under section 320 Cr.P.C: This section is not listed under Compoundable Offences i.e. compromise or settlement cannot be entered into by the parties.
