Heading of the Section: Punishment for voluntarily causing hurt


Overview: This is a penal section and provides for just the punishment to a person who is causing hurt to another person voluntarily.


Meaning of Voluntarily: It is important to note the term “Voluntarily” which is the gist to constitute an offence of hurt. Voluntarily basically means that there are knowledge and intention from your part while you are doing the act. If voluntariness is absent from your part then it does not constitute the offence of hurt.


Scope of this section: This section all covers all acts except for the acts provided by Section 334 of the Indian Penal Code.


Punishment for voluntarily causing hurt under 323 IPC: This section provides that if any person, except in the case provided for by section 334, if voluntarily causes hurt, then he shall be punished with imprisonment of either description for a term which may extend to one year, or with fine which may extend to one thousand rupees (Rs. 1000), or with both. z
